What the outline lists

The PSI state outline (p. 14) for these three areas:

  • Duties and powers of the Commission: its purpose, persons and disputes outside its jurisdiction, complaints, notifications and hearings, disciplinary actions.
  • Licensing requirements: exams, education, other qualifications, change of status, name or address, firm licenses and license display, renewal, E&O insurance.
  • Improper activities and consumer protection: improper listing agreements, discrimination, other misconduct.

What the Commission can and cannot do

The Commission licenses and disciplines; it does not settle money disputes. Its own rules say it will not intervene in debts, loans, draws or commission disputes between firms, brokers and affiliates (Rule 1260-02-.02(8)), so a fight over a split goes to court or arbitration, not to a complaint.

When it does act, a civil penalty is set per violation, from $0 to $1,000, and each day a violation continues can count as a separate one (Rule 1260-02-.32). The penalty can come on top of, or instead of, other discipline. The Commission weighs deterrence, the circumstances, the harm to the public and what the violator gained.

What is the maximum civil penalty the Tennessee Real Estate Commission can impose for a single violation?

Answer and explanations

Correct: Rule 1260-02-.32(1) sets a civil penalty of $0 to $1,000 for each separate violation, and each day of a continuing violation can count separately.

Incorrect: Two and a half times the cap; TREC's rule tops out at $1,000 per violation.

Incorrect: Affiliate brokers are licensees too, and most rules in chapter 1260-02 apply to them directly.

A Tennessee licensee buys an independent errors and omissions policy instead of the Commission's group policy. What must the independent policy do?

Incorrect: Coverage must reach all licensed activities, so a residential-only policy falls short.

Errors and omissions insurance

Every active licensee must carry errors and omissions insurance. An inactive or retired license needs none until it is activated again. You can buy into the Commission’s group policy or carry an independent policy, but the independent one must match the group policy’s limits, deductible, exemptions and term (Rule 1260-01-.15).

A lapse is expensive. A license suspended for more than 30 days for missing E&O is reinstated only with proof of coverage and a penalty. Up to 120 days it is $200 if the carrier back-dated the policy to show continuous coverage, $400 if it did not, and $200 for a licensee who is broker-released, retires or surrenders the license. From 120 days to six months it is $500. From six months to a year it is $500 plus $100 for each month, or part of a month, from month six to month twelve (Rule 1260-01-.16).

A changed firm is not a changed status

Leaving a firm starts a clock: within 10 days of the release you must complete a transfer or retire the license, and you may not practice until the Commission has processed the change. Listings and buyer agreements stay with the old firm unless its principal broker agrees in writing (Rule 1260-02-.02).

Licensing rules the exam returns to

  • Passing is not licensure. The rules say so outright: an applicant who passes is not necessarily qualified (Rule 1260-01-.01(3)).
  • Criminal history: a felony or theft-related misdemeanor in the past 10 years, or a licensing sanction, means a disclosure form, certified court records and an appearance before the Commission. An applicant denied after appearing before the Commission waits six months before it will reconsider.
  • Renewal: every 2 years, $75, from the Commission’s fee schedule.

The full license sequence is on how to get licensed. Federal fair housing law belongs to the national portion: disclosures and fair housing.
